Welcome to WebKickbacks. By accessing or using our website at webkickbacks.com, our browser extension, or any of our services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

1. Account Registration

To use cashback features, you must create an account. You agree to provide accurate information and keep it updated. You are responsible for maintaining the security of your account credentials. You must be at least 18 years old to create an account.

You may not create multiple accounts to abuse referral bonuses or cashback offers. We reserve the right to suspend or terminate accounts that violate this policy.

2. How Cashback Works

• Earning cashback: When you click through to a retailer via WebKickbacks and make a qualifying purchase, you earn cashback. Cashback rates are displayed on each store page and may change at any time.
• Tracking: Cashback is tracked via affiliate cookies. You must click through WebKickbacks immediately before making a purchase. Using other coupon extensions, clicking other affiliate links, or clearing cookies before checkout may prevent tracking.
• Pending period: Cashback starts as "pending" and moves to "available" after the retailer confirms the purchase (typically 30-90 days). This delay accounts for potential returns and cancellations.
• Reversals: If you return a product or the retailer reverses a commission, the associated cashback will be deducted from your account.

3. Payouts

• You may request a payout once your available balance reaches $10.00.
• Payouts are processed via PayPal or other supported methods (Venmo, ACH bank transfer, gift cards). You must provide valid payment details.
• Payout requests are typically processed within 5 business days.
• We reserve the right to delay or withhold payouts if we suspect fraud, abuse, or violations of these Terms.
• Unclaimed balances on inactive accounts (no login for 12 months) may be forfeited after written notice.

4. Cashback Rates and Availability

Cashback rates are provided by our affiliate network partners and may change without notice. We display rates in good faith but cannot guarantee their accuracy at all times. Some product categories or specific items may be excluded from cashback by the retailer.

We do not guarantee that every purchase will be tracked. Technical issues, ad blockers, cookie restrictions, or retailer changes may occasionally prevent tracking. We are not liable for missed cashback due to factors outside our control.

5. Browser Extension

Our browser extension detects when you visit a supported merchant website and notifies you of available cashback. The extension:

• Only activates on supported merchant domains.
• Does not track your browsing on non-merchant websites.
• Does not modify page content other than displaying cashback notifications.
• Does not collect or transmit your purchase amounts or cart contents.

6. Prohibited Conduct

You agree not to:

• Create multiple accounts or use fake identities.
• Use bots, scripts, or automated tools to generate clicks or purchases.
• Make purchases solely to earn cashback with the intent to return the items.
• Manipulate or attempt to manipulate the tracking system.
• Share your account credentials with others.
• Use the Service for any illegal purpose.

Violation of these rules may result in forfeiture of your cashback balance and termination of your account.

7. Intellectual Property

The WebKickbacks name, logo, website design, and content are owned by us and protected by intellectual property laws. You may not copy, modify, or distribute our content without permission. Retailer logos and trademarks displayed on our site belong to their respective owners.

8. Limitation of Liability

The Service is provided "as is" without warranties of any kind. To the maximum extent permitted by law, WebKickbacks shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits or lost cashback, arising from your use of the Service.

Our total liability for any claim related to the Service shall not exceed the amount of cashback earned by you in the 12 months preceding the claim.

9. Indemnification

You agree to indemnify and hold harmless WebKickbacks and its officers, directors, and employees from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

10. Modifications

We may update these Terms at any time. Material changes will be communicated via email or a notice on our website. Continued use of the Service after changes constitutes acceptance of the updated Terms.

11. Termination

You may close your account at any time. Upon closure, any available cashback balance above the minimum payout threshold will be paid out. Pending cashback will be forfeited. We may suspend or terminate your account for violations of these Terms.

12. Governing Law

These Terms are governed by the laws of the United States. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration, except where prohibited by law.
